Terms of Service

Effective September 18, 2026. Operated by BURSTCHAIN LLC ("Burst", "we", "us").

These Terms of Service (the "Terms") govern your access to and use of the Burst website, the Burst mobile application, and every related interface, API, and service we operate (together, the "Service"). By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1.What Burst is — and is not

Burst is a software interface. It lets you view, and interact with, creator coins and related smart contracts deployed on Robinhood Chain and on third-party launchpad infrastructure (including pons). The coins, the bonding curves, the pools, and the reward accounting are executed by smart contracts on a public blockchain. Burst does not hold, custody, or control your funds or your private keys at any time.

Burst is not an exchange, broker, dealer, money transmitter, investment adviser, or financial institution. We do not take the other side of any trade, set prices, or guarantee liquidity. Every transaction you submit is signed by you, in your own wallet, and executed by code on a blockchain that we do not control.

Nothing on the Service is an offer to sell, a solicitation to buy, or a recommendation of any token, coin, security, or investment. Coins listed on Burst are not endorsed by Burst, and their listing implies nothing about their value, legitimacy, or prospects.

2.Eligibility

You may use the Service only if you are at least 18 years old (or the age of majority where you live, whichever is greater) and legally able to form a binding contract. You may not use the Service if you are located in, organized under the laws of, or a resident of any jurisdiction where use of the Service or trading of digital assets is prohibited, or if you are subject to sanctions or appear on any government restricted-party list. You are solely responsible for determining whether your use of the Service is legal where you are, and for complying with every applicable law, including tax law.

3.Your wallet and account

Trading on Burst requires a blockchain wallet. On the website you connect a wallet you already control. In the app, an embedded self-custodial wallet may be created for you by our wallet infrastructure provider; the key material for that wallet is generated and secured on your device and within the provider's secure enclaves, and can be exported by you at any time. In every case, you control the keys. We cannot access, freeze, recover, or move your funds, and we cannot reset a lost key. If you lose access to your wallet or your recovery material, your assets may be permanently lost, and Burst has no ability to help.

You are responsible for everything that happens through your wallet and account, including all transactions signed with your keys. Keep your credentials, devices, and exported keys secure and never share them. Tell us promptly at the support contact below if you believe your account has been compromised, understanding that we cannot reverse blockchain transactions.

4.Creator coins, launches, and listings

Creator coins are tokens launched through third-party launchpad smart contracts. Launch mechanics — supply, pairing, bonding curve, graduation to a liquidity pool, trading fees, and any creator fee — are fixed by those contracts at launch and are displayed in the Service as read from the chain. Burst does not control those parameters and cannot change them after launch.

Burst lists coins that are launched by, or registered with, Burst. We may decline to list, or may remove from display, any coin at any time and for any reason, including legal risk, abuse, or impersonation. Removal from display does not affect the coin's existence on-chain, and coins remain tradable through the underlying contracts regardless of what Burst displays.

Creators appear on Burst only with their agreement. If you believe a coin or page uses your name, likeness, or brand without your authorization, contact us at the address below and we will review and, where appropriate, remove it from display.

5.Keys, points, leaderboards, and airdrops

"Keys" on Burst are a rewards score calculated from your on-chain activity, such as trading and holding creator coins and posting theses. Keys are not tokens; they are not transferable, purchasable, redeemable for cash, or owned property, and they carry no monetary value. Keys, the formula used to calculate them, leaderboards, and any related program may be changed, paused, reset, or ended by us at any time.

Any future token distribution or airdrop (including anything referred to as "$BURST") is entirely at our discretion, may never occur, may be restricted by jurisdiction, and may be conditioned on eligibility checks. No statement on the Service, in the app, or on social media creates any right to, or expectation of, a distribution. Do not use the Service based on the expectation of an airdrop.

6.Fees

Trades through the Service incur fees set by the underlying smart contracts (for example, a pool or curve fee and a creator fee), plus network gas paid to the blockchain. Fee amounts and their recipients are visible on-chain and shown in the Service before you confirm a transaction. Burst may receive a portion of protocol or creator fees. Fees are not refundable.

7.Risks you accept

Digital assets are extremely volatile and speculative. Creator coins in particular are new, thinly traded, and frequently lose most or all of their value. By using the Service you acknowledge and accept, among others, the following risks: total loss of funds; extreme price swings; low or no liquidity; slippage; failed or delayed transactions; smart-contract bugs or exploits in code we did not write; blockchain outages, forks, or reorganizations; changes to third-party launchpad or wallet infrastructure; regulatory action; phishing and social engineering; and your own mistakes (wrong address, wrong amount, lost keys), which cannot be undone. Only trade with funds you can afford to lose entirely.

Prices, charts, market caps, holdings, profit and loss, and leaderboards shown in the Service are computed from public blockchain data and third-party data feeds. They may be delayed, incomplete, estimated, or wrong. Do not rely on them as the sole basis for any decision.

8.Acceptable use

You agree not to, and not to help anyone else to:

  • use the Service for any unlawful purpose, including market manipulation, wash trading, or fraud;
  • impersonate any person or entity, or launch a coin using a name, likeness, or brand you have no right to use;
  • post content that is illegal, defamatory, harassing, hateful, sexually explicit, or that infringes anyone's rights;
  • interfere with the Service, probe or attack our systems, scrape at abusive rates, or bypass rate limits or access controls;
  • use bots or automation to gain an unfair advantage in rewards, leaderboards, or launches;
  • launder money, finance terrorism, or evade sanctions;
  • use the Service if you are barred from doing so under Section 2.

We may suspend or terminate your access to the Service, and remove content, at any time and without notice if we believe you have violated these Terms. Because we do not control the blockchain, suspension from the Service does not affect your on-chain assets.

9.Content you post

You retain ownership of the content you post (such as usernames, profile images, banners, and theses). You grant Burst a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the Service. You represent that you have the rights to post it and that it does not violate these Terms. Some content (for example, theses) is written to a public blockchain by you and cannot be deleted by Burst.

10.Third-party services

The Service integrates third-party services that we do not control, including blockchain networks, the pons launchpad, wallet infrastructure, on-ramps, image hosts, and data providers. Their availability, accuracy, and terms are their own. Your use of a third-party service is governed by that provider's terms, and Burst is not responsible for their acts or omissions.

11.Intellectual property

The Burst name, logo, designs, software, and content (other than user content and open-source components) are owned by BURSTCHAIN LLC or its licensors and are protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service as permitted by these Terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as allowed by law or an applicable open-source license.

12.Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY SMART CONTRACT, BLOCKCHAIN, WALLET, OR THIRD-PARTY SERVICE WILL FUNCTION AS INTENDED OR BE SECURE.

13.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BURSTCHAIN LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, DIGITAL ASSETS, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE FEES YOU PAID TO BURST IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14.Indemnification

You will defend, indemnify, and hold harmless BURSTCHAIN LLC and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

15.Dispute resolution and governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in court for infringement of intellectual property. YOU AND BURST WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

16.Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms; when we do, we will change the effective date above and, for material changes, give notice in the Service. Continued use after a change means you accept the updated Terms.

17.General

These Terms, with the Privacy Policy, are the entire agreement between you and Burst about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Notices to you may be given through the Service or to any email address you provide.
